SECTION 144 OF CRPC#

 Now a days I have been hearing these word ' section 144 ' a lot , so I thought of writing this topic.

What is section 144 of CRPC?

It is nothing but, an order issued by magistrate of any Indian state or union territory to prohibit the gathering of four or more people in a specific area. It is only imposed when there is a danger or damage to human life or property.

  • It places restrictions on holding or transporting of weapon of any kind like guns, knives etc., If found , the person will get a maximum punishment of 3 years.
  • There shall be no movement in public, and all educational institutions shall remain closed.
  • You can not hold any public meeting and some times It also gives authority to magistrate to block internet access in that region.
  • The order under section 144 can remain in force for a period of 2 months, if the state govt wants to extend the order then it can do it for a maximum period of 6 months.
MAGISTRATE: every one may have known the term judge . so, judge gives verdicts in a court. but , magistrate is a regional judicial officer, chosen by the high court judge. A magistrate is a civil servant who manages the law in a particular  area.

Then what is CRPC?

Criminal procedure code , 1974( CRPC) and also Indian penal code , 1860 ( IPC) are the laws that govern criminal law in India. You can also say as criminal justice system in India.

  • IPC defines crimes and prescribes appropriate punishments.
  • CRPC provides a detail procedure for punishments under penal laws.
